1. Introduction

These Terms of Service ("Terms") govern your use of apostille and document legalisation services provided by Attestation Limited, trading as LegaliseNow ("we", "our", "us", or "LegaliseNow").

By engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding with any order.

2. Definitions

"Apostille" means the certification issued by the UK Foreign, Commonwealth & Development Office (FCDO) under the Hague Convention of 1961.
"Services" means apostille, embassy attestation, notarisation, translation, and related document legalisation services.
"Documents" means any papers, certificates, or materials submitted for legalisation.
"Client" or "You" means the person or entity engaging our services.
"Turnaround Time" means the time from receipt of complete documentation and payment to completion of services.

3.3 Service Limitations

We provide intermediary services for document legalisation. Final acceptance of documents is determined by receiving authorities, not by us.

4. Order Process and Acceptance

4.1 Quotation and Booking

  • All quotations are valid for 30 days unless otherwise stated
  • Orders are confirmed upon receipt of signed agreement and payment
  • We reserve the right to refuse service at our discretion
  • Prices may change without notice but confirmed orders are protected

4.2 Document Requirements

  • Original documents or certified copies as appropriate
  • Clear, legible documents without damage or alteration
  • Complete information for all services required
  • Valid identification where required

4.3 Payment Terms

  • Payment required before service commencement
  • Accepted methods: bank transfer, card payment, PayPal
  • All prices include applicable fees unless stated otherwise
  • Additional charges may apply for expedited services

5. Client Obligations

You warrant that all documents submitted are:

  • Genuine and not fraudulent or forged
  • Legally obtained and owned by you or with proper authority
  • Accurate and complete
  • Not subject to any legal restrictions or disputes

5.2 Information Accuracy

  • Provide accurate contact and delivery information
  • Inform us immediately of any changes
  • Respond promptly to requests for clarification
  • Verify all details before final submission

5.3 Compliance

  • Comply with all applicable laws and regulations
  • Not use our services for illegal purposes
  • Respect intellectual property rights
  • Maintain confidentiality of sensitive information

6. Pricing and Payment

All payments are processed securely through encrypted systems. We do not store payment card information on our servers.

7. Delivery and Service Completion

7.1 Delivery Methods

  • Registered Post: For standard documents (insurance included)
  • International Delivery: Via DHL, FedEx, or similar services

7.2 Delivery Timeframes

Important: Turnaround times commence from receipt of complete documentation and cleared payment. Government processing times may vary.

  • • EU delivery: 2-5 working days
  • • International delivery: 3-10 working days
  • • Collection available same day as completion

7.3 Risk and Insurance

  • All deliveries are insured up to £500 unless otherwise arranged
  • Higher value insurance available on request
  • Risk transfers upon delivery confirmation
  • Professional indemnity coverage: £2 million

8. Cancellation and Refunds

8.1 Cancellation Rights

Consumer Rights

If you are a consumer (not acting for business purposes), you may cancel within 14 days of ordering unless service has commenced with your express consent.

8.2 Refund Policy

  • Before Processing: Full refund less administration fee (£25)
  • During Processing: Partial refund of unprocessed services
  • After Completion: No refund unless service failure proven
  • Government Fees: Non-refundable once submitted

8.3 Service Guarantee

We guarantee successful apostille issuance for eligible documents. If FCDO rejects a document due to our error, we will provide a full refund or reprocess at no charge.

9. Liability and Insurance

9.1 Limitation of Liability

Our liability is limited to:

  • The value of services provided (maximum £1,000 per document)
  • Direct damages only (no consequential or indirect losses)
  • Claims made within 12 months of service completion
  • Written notice of claim within 30 days of issue

9.2 Exclusions

We are not liable for:

  • Government rejection of documents
  • Changes in destination country requirements
  • Delays due to incomplete information
  • Force majeure events
  • Third-party service failures
  • Loss of business or profits

9.3 Insurance Coverage

Professional Indemnity: £2,000,000
Public Liability: £1,000,000
Document Insurance: Up to £500 per shipment (higher available)

10. Confidentiality and Data Protection

10.1 Confidentiality

  • All client information is treated as confidential
  • Documents are handled with appropriate security measures
  • Access limited to authorized personnel only
  • Secure destruction of copies after retention period

10.2 Data Protection

Personal data is processed in accordance with UK GDPR and our Privacy Policy. We implement appropriate technical and organisational measures to protect your data.

10.3 Document Retention

  • Original documents returned after processing
  • Copies retained for 7 years (legal requirement)
  • Digital records stored securely with encryption
  • Disposal in compliance with data protection laws

11. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including:

  • Government office closures or delays
  • Natural disasters, pandemics, or emergencies
  • Strikes, labour disputes, or transport disruptions
  • Changes in law or government procedures
  • Cyber attacks or system failures
  • Supplier or third-party service failures

In such events, we will make reasonable efforts to minimize delays and keep clients informed of progress.

12. Intellectual Property

12.1 Our Rights

  • All website content, logos, and materials are our property
  • Clients may not reproduce our materials without permission
  • Trade marks and branding are protected

12.2 Client Rights

  • Clients retain ownership of their documents
  • We do not claim rights to client materials
  • Translations and certifications become client property

13. Complaints and Dispute Resolution

13.1 Complaints Procedure

  1. Contact us immediately by phone or email
  2. Provide full details and supporting evidence
  3. We will investigate and respond within 5 working days
  4. If unresolved, escalate to management level
  5. Final written response within 15 working days

13.2 Alternative Dispute Resolution

If we cannot resolve your complaint internally, you may refer the matter to:

  • Trading Standards (for consumer issues)
  • Professional body mediation
  • Small Claims Court (for monetary disputes)
  • Online Dispute Resolution (EU platform)

13.3 Governing Law

These Terms are governed by English law. Courts of England and Wales have exclusive jurisdiction for any disputes.

We may update these Terms from time to time to reflect:

  • Updates to our services or procedures
  • Improvements to customer protection
  • Technical or operational changes

Significant changes will be notified by email or website notice. Continued use of our services constitutes acceptance of revised Terms.
